Film Incentives Update!

The Iowa Attorney General's office may examine all of the $32 million in tax credits issued to date, and attempt to recapture any that were not properly issued. Per the A.G.'s Chief of Staff, all credits awarded since the program started in 2007 will be scrutinized. Should any of the credits be cancelled, the buyers of those credits could lose what they paid for the credits. But it is probable that the state will first try to recoup from the producers of the challenged films.

Lawmakers are now giving odds of 50:50 that the program will continue, but with new regulations and safeguards in place. Meanwhile, no new applications will be accepted, and no credits issued.

This is independent of the criminal investigation into the tax credits and film office that is now in progress. For more information:

LOUISIANA TIGHTENS QUALIFYING RULES

Louisiana has tightened its rules relating to ordering goods and services from out-of-state vendors. For example, a camera rental house with an existing rental business may order camera equipment from another state if that product cannot be found in Louisiana, and the expense will qualify. A studio or services company that maintains stocks of different types of goods and supplies for sale or rent may order from out-of-state, and the rentals or sales to production companies will qualify. But rentals or purchases made using a pass-thru or shell company that maintains no rental or sales stock, but simply forwards orders to out-of-state vendors, and invoices using a Louisiana address, will not qualify.

IOWA PROGRAM TEMPORARY SUSPENDED

Citing irregularities in the film incentive program, Chester Culver, Governor of Iowa, temporarily suspended approval of new applications or issuance of tax credit certificates yesterday evening. Mike Tramontina, Director of the Iowa Department of Economic Development (DED), resigned. Tom Wheeler, Director of the Film Office, has been put on administrative leave.

The Incentives Office will provide additional information as soon as it is available.
